H-1B Lottery Explained

The H-1B lottery is a random selection process USCIS uses when the number of H-1B petitions filed exceeds the annual cap. Each fiscal year, USCIS receives petitions far beyond the 65,000 general cap plus 20,000 cap-exempt positions reserved for advanced degree holders (master's degree or higher from a US institution). When filings exceed available spots, USCIS conducts a computer-generated lottery drawing to determine which petitions move forward for adjudication.

How the Selection Process Works

In recent years, USCIS has implemented a two-stage lottery process. In the first stage, they randomly select petitions from the advanced degree pool. Remaining petitions enter a second lottery for the general 65,000 cap. Petitions not selected are rejected and returned to the employer. If your petition is selected, it then undergoes full USCIS review. Selection does not guarantee approval. Your petition must still meet all statutory and regulatory requirements for the H-1B visa category.

The filing window typically opens on a specific date, and USCIS receives thousands of petitions within hours. As of fiscal year 2024, the lottery remains highly competitive. In 2022, USCIS received approximately 483,000 petitions against 85,000 available slots, making your odds roughly 18 percent even if selected in the lottery.

Impact on Your Immigration Timeline

  • Timing uncertainty: Being selected in the lottery determines whether you can proceed to adjustment of status or consular processing. If not selected, you must wait until the next fiscal year to try again.
  • Priority dates: H-1B petitions do not have priority dates like employment-based green card applications. Selection in the lottery is your entry point into the system.
  • Work authorization: If selected and approved, your H-1B status typically begins on October 1st of that fiscal year, and your employer can request Employment Authorization Documents (EAD) if needed.
  • Bridge options: Some visa categories like L-1A, E-2, or O-1 may provide alternatives if your H-1B lottery petition is not selected.

Common Questions

  • Can I improve my odds of being selected? No. The lottery is purely random. Having multiple petitions filed by different employers increases your chances statistically, but each individual petition has the same probability of selection.
  • What happens if I'm not selected? Your petition is rejected. Your employer may file again in the next fiscal year, or you may explore other visa categories. You do not receive a refund of filing fees.
  • Does the lottery affect green card applications? Not directly. H-1B status is temporary work authorization. If you want permanent residency, you would need your employer to sponsor you through the employment-based green card process, which involves a separate priority date system and does not use lottery selection.
